This website is located at www.sisterhooddresshire.com. Under these Terms of Use, this Website provides a service for customers to borrow designer dresses Sisterhood Dress Hire.
Through the Services, we aim to give you access to beautiful Australian designer clothing and a stylist advice as well as other content to help you decide which items are perfect for you.
Definitions
In these Terms of Use “you” and “your” refer to all users of this Website and “we’, “us” and “our” refer to Sisterhood Dress Hire. References to users must be read as being also a reference to customers of Sisterhood Dress Hire.
LEGALLY BINDING Contract.
These Terms of Use constitute a binding legal contract between you and Sisterhood Dress Hire. These Terms of Use apply to you whether you are browsing or are a customer of Sisterhood Dress Hire. The Terms of Use in force at any time are published on the Website and you will be taken to have accepted them by accessing or using the Website. If Sisterhood Dress Hire develops revised terms of use then on their publication on the Website they will supersede those they replace. If you subsequently access or use the Website you will be taken to have accepted the revised terms of use. If you do not agree with the terms of use application from time to time, do not access, use, submit information to or download from this Website. These Terms of Use may change without notice, so do check from time to time. If you do not agree to any change, you should terminate the use of the Website. Specific Website offerings, incentives, areas, or section may also have additional guidelines which govern your use of this Website. You must comply with them in addition to these Terms of Use.
This agreement contains all of the terms and conditions regarding your rental of products from Sisterhood Dress Hire via the website www.sisterhooddresshire.com You agree that rental from our business is subject to all our website terms and conditions of use and privacy policy. These are available on our website and are subject to change from time to time. You agree that you are renting products and ownership of the product remains with Sisterhood Dress Hire at all times.
Our Commitment to you
We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Products may appear different in colour and style then the images listed on the website. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.
Payment
The rental price is calculated according to the rental period chosen by The Client and is inclusive of Goods and Services Tax (“GST”).
Payment of the rental price for online bookings is through Credit Card platforms (“Visa”, “Mastercard”) and must be made at the time the order is placed. Sisterhood Dress Hire is unable to process any orders until such payment is made and proof of payment is received.
Payment may also be made in cash or by card at the time of booking at the Sisterhood Dress Hire Location.
Once a Garment has been paid for in full, under no circumstances will a full refund be given (It is the responsibility of Client to try on the garment before booking in or have an understanding of their size requirements).
Sisterhood Dress Hire will securely store the card details of the Client until the Rental Period has ended. No extra charges will be made to this card if the Garment is returned in a condition and timeframe that is acceptable to Sisterhood Dress Hire to be determined at Sisterhood Dress Hire’s sole discretion.
03. Cancellations and Exchanges
If a cancellation is requested and greater than 2 weeks notice is given prior to the Event Date, the customer can choose to receive a refund minus a 50% Cancellation Fee. Or, the customer can choose to receive a Store Credit for the full amount.
If a cancellation is requested and less than 2 weeks notice is given prior to the Event Date, the customer can choose to receive a Store Credit less a 50% Cancellation Fee. Customers will not be eligible for a refund.
If a change of date is requested and greater than 2 weeks notice is given prior to the Event Date, a change of date can be actioned (subject to Garment availability) at the cost of a 20% Processing Fee.
If a change of date is requested and less than 2 weeks notice is given prior to the Event Date, a change of date can be actioned (subject to Garment availability) at the cost of a 25% Processing Fee.
If an exchange of Garment (size or style) is requested and greater than 2 weeks notice is given prior to the Event Date, an exchange can be actioned (subject to Garment availability).
If an exchange of Garment (size or style) is requested and less than 2 weeks notice is given prior to the Event Date, an exchange can be actioned at the cost of a 25% Processing Fee (subject to Garment availability).
In the event of an exchange, the difference in Hire Fee must be paid to Sisterhood Dress Hire if the new Garment is a higher price than the original Garment. If the new Garment is a lesser price than the original Garment, the customer will not receive a refund of the difference however the difference can be put into a store credit for a next hire.
Returns and Late Fees for Local Hires
All Garments are to be returned on Monday evening or Tuesday E.O.D (immediately following the Rental Period) directly to Sisterhood Dress Hire.
Alternate arrangements for the return date can be made and agreed on in good faith with Sisterhood Dress Hire prior to the commencement of the Rental Period.
Late fees are applied if not returned by the return date and a $10 per day is charged to the Client until the Garment is returned, payable in Australian Dollars.
The garment is deemed a non-return after 14 days and the client will be charged 100% of the Recommended Retail Price (“RRP”) as listed on the Sisterhood Dress Hire website, payable in Australian Dollars.
If a late return results in subsequent cancellation of an upcoming confirmed hire, the Borrower will be charged the full value of that hire in addition to late fees.
05. Return Items and Late Fees for Posted Returns.
Garments being returned via post are to be posted on Monday (immediately following the Rental Period) and must be lodged at an Australia Post Office or Australia Post Yellow Express Box before 3pm.
If a Public Holiday falls on the Monday, then the Garment must be lodged on the Tuesday instead before 3pm.
Garments must be returned in the packaging provided by Sisterhood dress Hire, using the pre-paid postage label or satchel provided by Sisterhood Dress Hire.
Late fees of $10 per day are applied if the garment is not lodged by the required date.
If the late return results in the parcel not being delivered before the upcoming weekend, the Borrower will be charged the full value of the hire fee.
If a late return results in subsequent cancellation of an upcoming confirmed hire, the Borrower will be charged the full value of that hire in addition to late fees.
The garment is deemed a non-return after 14 days and the client will be charged 100% of the Recommended Retail Price (“RRP”) as listed on the Sisterhood Dress Hire website, payable in Australian Dollars.
06. Cleaning
All cleaning of The Garment is taken care of by Sisterhood Dress Hire. By hiring The Garment the Client agrees that they will not attempt to clean the garment, doing so may result in a non-return fee to be paid.
The cost of cleaning is included in the hire fee, provided the garment is returned in reasonable condition. Major staining will incur extra charges, starting from $15.
07. Damages
It is expected that all Garments are returned in the condition that they were received by Sisterhood Dress Hire.
It is the responsibility of The Borrower to inspect The Garment after it has been collected or received. If the condition of The Garment is not satisfactory or any damages are noticed, The Borrower has 4 hours from the time of pick up to notify Sisterhood Dress Hire of said damages with photographic evidence. If the defects are deemed minor and in line with what is to be expected of a Hire Garment then The Borrower may continue with the hire. If Sisterhood Dress Hire deems The Garment to be unwearable then The Borrower is eligible for an exchange (where possible) or a full refund. The definition of Minor vs Major is at the discretion of Sisterhood Dress Hire.
If Sisterhood Dress Hire is not notified within 4 hours from the time of pick up or delivery of any damages then it will be assumed that The Borrower is satisfied with the condition of The Garment.
If a Garment is returned with minor damages, the client agrees to pay for the repair (in addition to the rental price). The price will be determined in good faith by Sisterhood Dress Hire in conjunction with Sisterhood Dress Hire’s seamstress and/or dry cleaning provider.
If a Garment is returned with major damages, either beyond repair or ruined determined at the discretion of Sisterhood Dress Hire, The Client agrees to pay the full replacement cost of the garment which will be determined in good faith by Sisterhood Dress Hire and may be up to but not above the RRP of the garment. This will be paid within 14 days of the Garment being returned.
It is at Sisterhood Dress Hire’s sole discretion to determine whether the damage is deemed “Minor” or “Major” as well as the repair cost
Refunds will be available if garments are received damaged as per Australian Consumer Law (beyond normal wear and tear of a hire garment). Clients recognise that they are wearing a second hand Garment that has been worn by other people. Thus, some wear and tear is to be expected. Sisterhood Dress Hire will not provide refunds for garments received that have normal wear and tear of a hire garment.
